Factories in Karnataka can ask employees to work 60 hours a week till 21-08-2020

The Government of Karnataka vide a notification dated 22nd May 2020 has exempted the factories from the provisions of Section 51- weekly hours and Section 54- Daily hours of the Factories Act 1949. As per the notification, Government of Karnataka extended the maximum working hours in factory till 10 hours (daily) and 60 hours (weekly). This extended working hours are effective from 22nd May 2020 to 21st August 2020 with the following conditions-

  1. No adult worker shall be required or allowed to work in a factory for more than 10 hours in a day and 60 hours in any week. Prior to the notification, the maximum working hours allowed were 9 hours in any day and 48 hours in any week.
  2. Provision of Section 59 in respect of overtime work shall continue to be applicable without any change. Section 59 provides that where a worker works in a factory for more than 9 hours in any day or for more than 48 hours in any week, in respect of overtime work, he shall be entitled to wages at the rate of twice his ordinary rate of wages.

As the Notification provides that the Section 59 shall continue to be applicable without any change, the extended 1 hour daily and 12 hours weekly shall be considered and payable as overtime work.
