ESIC relaxes restriction of 42 days to file return of contribution for Jammu & Kashmir

The Employee State Insurance Corporation (ESIC) vide a letter dated 17th January 2020 has relaxed the restriction imposed on employers for filling contribution after 42 days of the end of the contribution period for the employers of Union Territory Jammu and Kashmir due to the ban in internet service in the area. As per the letter, the employers of Union Territory Jammu and Kashmir can file return and deposit ESI monthly contribution for the contribution period ending on September 2019 till 29th February 2020.

Para 26 of Employees’ State Insurance (General) Regulations, 1950 provides that every employer shall send a return of contributions along with receipted copies of challans for the amounts deposited in the Bank, within 42 days of the termination of contribution period to which it relates. The online system permitted employer for submission of filling return of contribution only within 42 days after the end of contribution period and not after that.

But in view of ban and restrictions of internet services in the Union Territory Jammu and Kashmir, the Director General has relaxed the provisions of Para 26 for the employers of Jammu and Kashmir and allowed the employers to file return of contribution after 42 days of the termination of contribution period. However, this relaxation is granted only in respect of return for contribution period ending on September 2019. Apart from this, it is also cleared that payment of contribution shall be made through online mode only.
